all associations are required to adopt
election rules to ensure secret balloting and fair elections as
provided for in the Davis-Stirling Act.
If an association
violates these provisions, a court may award injunctive relief,
impose a civil penalty of up to $500 for each violation, and/or void
the election results. The court is required to award a successful
plaintiff reasonable attorney fees and costs.
