ATTORNEYS' FEES

In Moran v. Oso Valley Greenbelt Association an owner sued her association for delays in allowing her to inspect minutes. The association claimed the minutes were scatted in boxes and not in any particular order. Two months later, Ms. Moran and her attorney were given a date for the inspection provided she pay in advance a $200 administrative fee and a $35.00 copy charge.

Ms. Moran filed suit seeking production of the records and her attorneys fees. The Association produced the records shortly after the lawsuit was filed. The appeals court decided the records would not have been produced if Ms. Moran had not filed suit and, therefore, Ms. Moran was entitled to $58,485 in legal fees despite the fact her attorney was working pro bono.
