ELECTION RULES REQUIRED

Beginning July 1, 2006, all associations are required to adopt election rules that apply to elections requiring a vote by the membership, such as:

  • election of directors

  • removal of directors

  • special assessments

  • amendments to the CC&Rs and bylaws

  • grants of exclusive use common areas

All associations are required to adopt election rules that comply with Civil Code §1363.03 to include the following:

  • nomination procedures
  • candidate qualifications
  • a method of selecting independent third parties as inspectors of election
  • rules regarding access to association media during campaigns
  • rules regarding access to common area meeting space during campaigns
  • secret balloting procedures
  • a ballot form

For smoother elections, associations should amend their bylaws.
