ALTERATIONS TO ACCOMMODATE DISABLED

Disabled or handicapped owners are allowed to make alterations to their units or the common areas at their own expense to accommodate their handicap. Civil Code §1360(a) The right to make modifications is subject to the following conditions:

1.  The alterations may not impair the structural integrity or mechanical systems or lessen the support of any portions of the development.

2.  They must be consistent with applicable building codes.

3.  They must be consistent with the governing documents pertaining to safety or aesthetics.

4.  They must not prevent reasonable passage by other residents, and must be removed when the unit is no longer occupied by persons requiring the modifications.

5.  Owners who intend to make modifications must submit plans and the association may not deny approval without good cause.

Title VIII of the Civil Rights Act of 1968 is known as the Fair Housing Act. The Fair Housing Act makes it illegal to discriminate in housing related transactions on the basis of race, sex, religion, national origin, color, families with children, or the disabled.
