COMMITTEE
FORMATION Formation. Unless the governing documents provide otherwise, committees are created by and serve at the pleasure of the board. When a committed is created, boards must appoint a chairman and assign responsibilities to the committee. It should also set deadlines for completion of the committee's projects. For "ad hoc" committees, once the assigned project has been completed, the committee automatically dissolves unless the board assigns additional projects to the committee. Appointing Committee Members. Members do not have the right to appoint themselves to committees. That is a right reserved to the board or any officer designated by the board to appoint committees. Corp. Code §7151(c)(4) In the alternative, some boards appoint a committee chairman and allow the chairman to appoint his/her own committee members. Unless prohibited by the governing documents, committees may consist of persons who are not members of the association. Powers. Except for "Executive Committees," committees are advisory in nature and do not have any powers. There is an exception for committees created by the governing documents, which may have independent powers provided for in the CC&Rs or bylaws.
